Regular City Council Meeting

June 15, 2009

 

 

The Mt. Vernon City Council met in Regular Session on Monday June 15, 2009 at 7:00 p.m. in the Rolland W. Lewis Community Building at Veterans Park.

 

Mayor Mary Jane Chesley called the Regular Council Meeting to order and Reverend Jerry Van Houtin gave the invocation.

 

The Pledge of Allegiance was given.

 

Roll call showed present: Council Member Mary Burgan, Council Member Todd Piper, Council Member David Wood and Mayor Mary Jane Chesley.  Absent: Council Member Dennis McEnaney.

 

The journals for the November 17, 2008 City Council Executive Session,  the December 1, 2008 City Council Executive Session, the April 20, 2009 City Council Budget Workshop Meeting and the June 1, 2009 Regular City Council Meeting were presented to Council for any additions, deletions or corrections.  Motion by Council Member Mary Burgan to approve the journals as presented.  Second by Council Member Todd Piper.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

The Consolidated Vouchers for Accounts Payable for June 2009 in the amount of $1,294,561.92 were presented for Council’s consideration.  Motion by Council Member David Wood to Approve the Consolidated Vouchers for Accounts Payable for June 2009 in the amount of $1,294,561.92 as presented.  Second by Council Member Mary Burgan.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

BIDS AND QUOTES

 

City Manager Ron Neibert stated that bids had been returned for one 2009 Police Vehicle.  The bids were given to Police Chief Chris Mendenall to open before the

 

 

meeting. Chief Mendenall reported on the bids received.  The bids were as follows:

 

Svanda Chevrolet  2009 Tahoe                                          $29,153.00

Whiteside Chev. - St. Clairesville, OH  2009 Tahoe         $28,563.00                                                            

Ford Square 2009 Explorer                                                  $23,994.55

Ford Square 2010 Explorer                                                  $25,963.55

 

Chief Mendenall stated that he suggested that the City accept the low bid from Ford Square for the 2009 Ford Explorer in the amount of $ 23,994.55. He stated that the vehicle meets all of the specs requested.  City Manager Ron Neibert concurred. Motion by Council Member David Wood to approve the Purchase of a 2009 Ford Explorer from the bids received from Ford Square in the amount of $23,994.55. Second by Council Member Todd Piper. Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

CITY MANAGER

 

City Manager Ron Neibert presented to Council a Request Authorizing to Bypass the Formal Bid Process for a TSI Port-A-Count #8030 Tester for the Fire Department. Fire Chief James Brown addressed Council regarding this request.  He stated that this is a machine to fit test the pressure on the facemasks that they wear. Currently they have to borrow a machine from Centralia to test the masks.  MABAS requires that the masks are tested at least annually but sometimes they need to be repaired and tested after the repair.  There have been times when there has been a problem in borrowing the equipment from Centralia because it may be on loan to someone else.  Council Member David Wood asked what the estimated cost of this equipment was.  Chief Brown stated that it was $8,565.00. Council Member Mary Burgan asked if this was in the budget. Council Member Todd Piper asked what the life expectancy of the equipment was. Mayor Chesley asked if MABAS would help the City buy one. Chief Brown stated that they usually only purchase one unit per MABAS division. That is how Centralia got their unit.  Council Member David Wood stated that he would like to wait and get a little more information before deciding on this issue. He stated that the amount is quite a bit of money for equipment that would only be used once a year. Council concurred.

 

City Manager Ron Neibert presented to Council a Request to Bypass Formal Bidding Procedures for Street Milling.  Mr. Neibert stated that this is a matter of timing and the contractors. We need to get them lined up for when they are available and when we can have the streets ready to do.  We will ask for quotes for the work. Motion by Council Member Mary Burgan to Bypass the Formal Bidding Procedure for the Street Milling for this year as requested.  Second by Council Member David Wood.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

City Manager Ron Neibert presented for Council’s consideration the Preliminary Plat for Renaissance Hills Subdivision Located at South Water Tower Circle. Mr. Dean Greenwalt was present to report on this project. Mr. Greenwalt stated that there are not any major changes to this plat. There are 14 lots. Some will be for residences and some for professional buildings.  He has presented this to the Planning and Zoning Board and there were no objectors. Motion by Council Member David Wood to Adopt the Preliminary Plat for the Renaissance Hills Subdivision as presented. Second by Council Member Todd Piper.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

CITY ATTORNEY

 

City Attorney David R. Leggans presented for Council’s consideration the First Reading of an Ordinance Regarding the Prevailing Wage Rate. City Manager Ron Neibert stated that this is an Ordinance that has to be passed annually. It sets the prevailing wage for any work done by contractors for the City. Motion by Council Member David Wood to Suspend the Rules to Vote on an Ordinance. Second by Council Member Mary Burgan.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnanaey.  Motion by Council Member David Wood to Adopt Ordinance # 2009-19, an Ordinance Regarding the Prevailing Wage Rate.  Second by Council Member Mary Burgan.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

City Attorney David R. Leggans presented for Council’s consideration the First Reading of an Ordinance Rezoning Property Located at 1204 Bethel Road from Class R2 to Class RM2. The petitioning party is Kenneth Nason.  Mr. Nason stated that this is an empty lot that has had a mobile home on previously. He wants to sell the lot, but the buyer wants to be sure that they can put a mobile home on the property. Motion by Council Member Mary Burgan to Suspend the Rules to Vote on an Ordinance. Second by Council Member Todd Piper.  Yeas: Burgan, Piper, Wood and Chesley. Absent: McEnaney.  Motion by Council Member Mary Burgan to Adopt Ordinance # 2009-20, an Ordinance Rezoning Property Located at 1203 Bethel Road from Class R2 to Class RM2 for Petitioning Party Kenneth Nason.  Second by Council Member David Wood.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

City Attorney David R. Leggans presented for Council’s consideration the First Reading of an Ordinance Rezoning Property Located at 18245 E. IL Highway 15 from Class AG to Class R1.  The Petitioning party is Cathy S. Murphy Trust. Mr. Calvin Murphy was present and stated that they want to rezone this property to be used for storage buildings. The rezoning would allow for the setback to be 15 foot instead of the 100 foot required by an AG zoning also. Motion by Council Member David Wood to Suspend the Rules to Vote on an Ordinance.  Second by Council Member Mary Burgan.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.  Motion by Council Member David Wood to Adopt Ordinance

 

# 2009-21, an Ordinance to Rezone Property Located at 18245 E. IL Highway 15 from Class AG to Class R1 for Petitioner Cathy S. Murphy Trust. Second by Council Member Todd Piper.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

City Attorney David R. Leggans presented for Council’s consideration the First Reading of an Ordinance Vacating Summer’s Ridge Subdivision Located at 900 McCauley Road. The petitioning party is Tom Newton.  Mr. Newton was present and stated that he wants to vacate this subdivision. He stated that it is a 5-lot subdivision and there have been no improvements to the property.  His reason to vacate is for tax purposes. Motion by Council Member Todd Piper to Suspend the Rules to Vote on an Ordinance.  Second by Council Member David Wood.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.  Motion by Council Member Todd Piper to Adopt Ordinance # 2009-22, an Ordinance Vacating Summer’s Ridge Subdivision Located at 900 McCauley Road for Petitioner Tom Newton as presented.  Second by Council Member David Wood.  Yeas: Burgan, Piper, Wood and Chesley.  Absent: McEnaney.

 

MAYOR

 

Mayor Mary Jane Chesley spoke about and read two letters received from Johnston City and Marion for Mt. Vernon sending men, trucks, saws and other equipment down to help with storm cleanup from the bad wind storms that hit that area. Both Cities thanked Mt. Vernon for being so generous to send help when they were in need.
