Conditional Use
Sometimes, a property owner wants to use land in a way that is not normally allowed in a specific zoning district. When this happens, they may request a Conditional Use Permit. This process allows the City to review the request while ensuring nearby properties and the surrounding neighborhood are protected.
Conditional Use Permits are reviewed on a case-by-case basis and must meet the standards outlined in the City of Mt. Vernon’s zoning regulations.
When a Conditional Use Permit Is Required
A Conditional Use Permit may be needed when a proposed use:
- Is allowed only under certain conditions in the zoning district
- Could impact nearby properties, traffic, or public services
- Requires additional review beyond a standard building permit

How to Apply
To request a Conditional Use Permit:
- Download the Conditional Use Application or obtain a copy from the City Engineer's Office
- File the completed application and required forms with the City Clerk's Office
- A $25 filing fee is required at the time of submission
- To obtain a public hearing date, contact the Zoning Administrator
The Planning and Zoning Commission generally meets on the second Monday of each month at 7:00 p.m. at City Hall, 1100 Main Street, Mt. Vernon, Illinois. Meeting dates are subject to change.
Public Notice Requirements
Public notice must be completed before the Planning and Zoning Commission public hearing.
Notice must be provided no less than 15 days and no more than 30 days prior to the hearing date. The applicant is responsible for ensuring the following notices are given:
- Mail notice to the property owner, if the owner is not the applicant
- Newspaper publication in a newspaper of general circulation within Mt. Vernon
- Posting notice at City Hall and in a prominent location on the subject property
The City provides the official property posting sign. A $50 refundable deposit is required and returned once the sign is removed after City Council action.
Proof that all required notices have been given must be submitted to the City Clerk’s Office prior to the hearing.
Review and Approval Process
- The City Manager reviews the application for completeness and compliance
- After proper public notice, the Planning and Zoning Commission conducts a public hearing and makes a recommendation
- Required documents must be presented at the Planning and Zoning Commission hearing
- The proposed ordinance is then presented to the City Council for consideration and action
- The applicant is required to appear at all scheduled meetings related to the request
Documents Required for the Planning and Zoning Commission Hearing
Applicants are responsible for bringing the following materials to the public hearing:
- Three copies of the Planning and Zoning Commission Resolution
- Certification of publication from the newspaper
- Certificate of posting
- Certificate of mailing to the property owner, when applicable
- Copies of zoning application forms filed with the City Clerk’s Office
City staff can assist applicants in confirming required materials prior to the hearing.
Important Things to Know
- Conditional Use Permits often include specific conditions or requirements that must be followed
- Some permits may be approved for a limited period of time
- Conditional Use Permits are granted to a specific applicant and do not transfer if the property is sold
- Approval of a Conditional Use Permit does not replace the need for building permits or other required approvals
