Variances

Sometimes, meeting zoning requirements is difficult due to unique property conditions. In these situations, a property owner may request a Variance, which allows limited relief from specific zoning rules while maintaining the intent of the City’s regulations.

Variances are reviewed on a case-by-case basis and are intended to address practical difficulties caused by property characteristics, not personal preferences.

When a Variance May Be Needed

A variance may be requested when a property has unique conditions such as:

  • An unusual lot size or shape
  • Existing buildings that were constructed before current zoning rules
  • Physical limitations that make compliance with zoning standards impractical

City staff can help determine whether a variance is appropriate or if another solution may be available.

Common Variance Examples

  • Requesting a taller fence due to location or safety concerns
  • Modifying setback requirements because of lot configuration
  • Allowing continued use of an existing structure that does not fully comply with current zoning standards

How to Apply

To request a variance, you must:

  • Download the Variance application or obtain a copy from the City Engineer's Office 
  • Complete a Zoning Application Form and Variance Application Supplement
  • File the completed application and required forms with the City Clerk’s Office
  • A $25 filing fee is required at the time of submission

Public Notice Requirements

Public notice must be completed before the Planning and Zoning Commission public hearing.

Notice must be provided no less than 15 days and no more than 30 days prior to the hearing date. The applicant is responsible for ensuring the following notices are given:

  • Mail notice to the property owner, if the owner is not the applicant
  • Newspaper publication in a newspaper of general circulation within Mt. Vernon
  • Posting notice at City Hall and in a prominent location on the subject property

The City provides the official property posting sign. A $50 refundable deposit is required and will be returned once the sign is removed after City Council action.

Review and Approval Process

  • After proper public notice, the Planning and Zoning Commission conducts a public hearing
  • The Commission meets on the second Monday of each month at 7:00 p.m. at City Hall, 1100 Main Street, Mt. Vernon
  • The applicant must attend the hearing to present the request and answer questions
  • If approved, the request is forwarded to the City Council for final consideration
  • The applicant must attend both City Council readings before final action is taken

Documents Required for the Planning and Zoning Commission Hearing

Applicants are responsible for bringing the following materials to the public hearing:

  • Certification of publication from the newspaper
  • Certificate of posting
  • Certificate of mailing to the property owner, when applicable
  • Copies of zoning application forms filed with the City Clerk’s Office
  • Plot plan of the proposed variance
  • Proof of compliance with the Soil and Water Conservation District Act, when applicable
